Here is the cost part.

You can apply to license my images based on an initial yearly fee.

Additional use beyond the originally agreed use, for example a licensed web site image being used for printed material, additional licence fees may occur.

You may purchase my images outright.

This may be for corporate or commercial reasons where you need to be the sole owner of the image for branding or identity purposes for example.
I will relinquish the copyright to the image and delete any originals I have after successful transfer and receipt of the image to the new owner has been confirmed.
I reserve the right to deny sale and transfer should I deem the use of the image as misrepresentative of and persons that may feature in the image, for instance, advertising escort services.
Also, if I feel that the image may be used to represent illegal activities like fraud.

Here is the legal part.

(1)  If you want to use my photos commercially, you are required to negotiate a licensing fee.
If you use my photos without © Copyright permission, you will politely be asked to remove the image or comply to adding appropriate copyright notices if you are a non-commercial web site
If you refuse to comply legal actions will be taken against you. .You will be subject to a large fine per photo under international law, plus punitive damages.
If you feel that my photos are worth using to enhance my business, than my photos are worth paying for.

(2) You may not print my images for commercial use that includes hanging them is a commercial location. You may not copy my images via oil paintings, pastels or in any form or fashion without written permission.

(3) However, you may use my photo samples only on non-commercial web sites as long as,
(a) You in no way you or anyone else stand to make money directly or indirectly.
(b) You provide a visible, clickable link back to www.hyperxp.com or state the image is © Copyright of Paul Hamlet, Hyperxp.com in type no smaller than that of related text.
(c) You contact me at hyper@hyperxp.com with the URL of your web site and how you would like to use the image.
(d) You do not remove/alter any watermarks on the image or embedded in the image.
(e) You do not alter or edit the image in any way.
(c) Otherwise you will be invoiced and or prosecuted for © Copyright violation per photo.

(4) When in doubt about my © Copyright, simply contact me.

My images are digitally embedded with a watermark confirming ownership of the image.
The digital watermark also allows me to find images being used online without my permission or payment. You will be found.

Here is the personal part.

I am an easy going person and I am usually happy to allow use of my images if you correctly credit me along with the image. Just drop me an email and state which image you wish you use and how you wish to use it.
In most circumstances where the request is for personal web sites, art projects, non profit commercial use or charity organisations, permission will be granted once I am happy that the terms in section 3 have been met.
All the images you will find on the web will be low resolution compressed JPEG and not suitable for printing. I hold all original images which will be released for commercial use only upon agreement of the licensing fee.

As most of my images are from music events around the United Kingdom, licensing fee may be wavered under certain circumstances where image use may/will provide publicity to myself as a photographer, my images and hyperxp.com.
For example, where an organiser/owner of an event may wish to use my images on their web site to promote further events, use the image on/as a flyer or promotions material, where I am the sole provider of images in both these instances.

I reserve the right to upload my images to a select few online public photo galleries without the graphical copyright notice on the image but containing the digital watermark.
These sites include but are not limited to flickr, picassa, facebook & DontStayIn.com

Please Note: Photos taken after 1987 do not require the © Copyright symbol on the photograph to be legally copyrighted, as © Copyright is now automatically given to the photographer unless he has signed a special work for hire contract that states the photographer retains no rights to the photographs.
